CBP stops collecting IEEPA tariffs

Duties imposed under the International Emergency Economic Powers Act, including the reciprocal tariffs, the fentanyl tariffs on Canada, Mexico and China, and the tariff on Brazil, are no longer collected on goods entered from Feb 24, 2026 (Executive Order 14389).

CBP stopped collecting the additional duties imposed under the International Emergency Economic Powers Act (IEEPA) on goods entered, or withdrawn from warehouse, for consumption on or after 12:00 a.m. eastern time on Feb 24, 2026. Its message lists the orders covered:

  • the reciprocal tariffs (Executive Order 14257)
  • the tariffs over illicit drugs on goods of Canada, Mexico and China (Executive Orders 14193, 14194 and 14195)
  • the tariffs on countries importing Venezuelan oil (Executive Order 14245)
  • the tariff on Brazil (Executive Order 14323)
  • the tariff on India over Russian oil (Executive Order 14329), which had already ended on Feb 7, 2026

The President ordered the change in Executive Order 14389, signed Feb 20, 2026 (91 FR 9437), which says these duties "shall no longer be in effect and, as soon as practicable, shall no longer be collected." CBP has described the order as issued in light of the Supreme Court's decision the same day in Learning Resources, Inc. v. Trump, which held that IEEPA doesn't authorize the President to impose tariffs (91 FR 37789).

The order doesn't affect Section 232 or Section 301 duties, and it left in place the suspension of duty-free de minimis treatment, which Executive Order 14388 continued. A 10% surcharge under Section 122 started the same day. Details are on the IEEPA program pages.
