Section 301 exemption for China cranes under pre-May 2024 contracts ends

Ship-to-shore gantry cranes of China that fulfill sales contracts dated before May 14, 2024 were exempt from the 25% Section 301 tariff only if entered before May 14, 2026. From that date they pay it like other such cranes.

Since Sep 27, 2024, ship-to-shore gantry cranes of China (8426.19.00) have paid a 25% Section 301 duty on top of the regular duty (heading 9903.92.10), under USTR's four-year review of the China tariffs.

Heading 9903.91.09 exempted cranes "that are fulfilling in whole or in part an executed contract for sale dated prior to May 14, 2024 for goods that are entered for consumption, or withdrawn from warehouse for consumption, in the United States prior to May 14, 2026", when the importer provided the certification in Annex D of USTR's notice. That window has closed: cranes entered from May 14, 2026 pay the 25% whatever the contract date.
