What it is

In its Section 301 investigation of China's targeting of the maritime, logistics and shipbuilding sectors, USTR imposed 100% tariffs, effective Nov 9, 2025, on intermodal chassis and chassis parts of China and on ship-to-shore gantry cranes from any country that are products of China, contain any of the Chinese components listed in note 31(l)(ii), or are made by a Chinese-controlled company. Chinese cranes would also pay the 25% from the 2024 four-year review (9903.92.10). Under the Nov 1, 2025 U.S.-China deal, USTR suspended every action in the investigation from Nov 10, 2025 through Nov 9, 2026 and moved the tariff headings' start date to Nov 10, 2026. USTR said it would consider before that date whether to continue the suspension; no notice doing so was found as of Sep 30, 2026. Cranes fulfilling sales contracts dated before Apr 17, 2025 and entered before Apr 18, 2027 are exempt when the importer attests to it.

Legal authority: Section 301 of the Trade Act of 1974, as amended; action by the U.S. Trade Representative in the investigation of China's targeting of the maritime, logistics and shipbuilding sectors for dominance (determined Apr 17, 2025; modified under section 307 on Oct 10, 2025), suspended at the direction of the President. Section 301 of the Trade Act of 1974 lets the U.S. Trade Representative act against foreign acts, policies and practices that are unreasonable or discriminatory and burden U.S. commerce, including by adding duties on imports.

How it combines with other duties

Charged on top of the base rate: note 31(a) says products of China under 9903.91.12 and 9903.91.14 “shall also be subject to the general rates of duty”, and its chapter 98, trade-agreement and antidumping rules apply as for the rest of note 31. Chinese ship-to-shore cranes pay the 25% of 9903.92.10 as well: “Notwithstanding U.S. note 1 to this subchapter, products of China that are subject to the additional duties imposed by heading 9903.91.14 shall also be subject to the additional duties imposed by heading 9903.92.10.” (note 31(l)(i)). “Heading 9903.91.14 shall not apply to entries under headings 9903.91.09 (as long as it is operative), 9903.91.15 or 9903.91.16.” The chassis subheadings 8716.39.00, 8716.90.30 and 8716.90.50 are also on the List 3 product list (note 20(f), heading 9903.88.03); neither note says whether 9903.91.12 applies instead of that duty or in addition to it (see open questions).
