Section 232 tariff and minimum import prices on polysilicon and solar products announced for Dec 4

Proclamation 11052 sets a 15% Section 232 tariff on polysilicon ingots and derivatives such as wafers, solar cells and modules, plus minimum import prices, for goods entered from Dec 4, 2026. Commerce can bar importers it finds stockpiling before then.

Proclamation 11052, signed Aug 6, 2026, adjusts imports of polysilicon and its derivatives under Section 232 of the Trade Expansion Act of 1962. Its duties apply to goods entered from 12:01 a.m. eastern time on Dec 4, 2026:

  • Tariff: polysilicon ingots and the polysilicon derivatives listed in the proclamation's annexes pay an additional 15%. For Japan, South Korea, Taiwan, Switzerland, Liechtenstein and the EU, the tariff and the regular duty together come to 15%; for the United Kingdom the rate is 10%.
  • Minimum import prices: $21 per kilogram for polysilicon, $100 per kilogram for polysilicon ingots and wafers, $0.22 per watt for solar cells and $0.38 per watt for solar modules. An importer that doesn't submit documentation that the first arm's-length sale in the United States will be at or above the minimum price, or is under fixed terms in a contract signed before Aug 6, 2026, pays a specific duty equal to the minimum price. One that does, but whose entered value is below the minimum, pays the difference.

Until Dec 4, Commerce can restrict imports by companies it finds stockpiling. Under its temporary rule, in effect Sep 22 through Dec 3, 2026 (91 FR 60505), importers bringing in these products "in volumes substantially greater than their historic averages", and new importers over weekly limits, can be barred from entering them before Dec 4 (CBP CSMS # 69994928).
